A major component of our internet defamation business is helping attorneys successfully deal with hidden or anonymous attackers. As a side benefit, we can give you immediate insight into what works around the country and where the landmines are located. For some simple cases, where an attorney is attempting a simple John Doe type approach, we often see cases get hung up in very simple (for us) issues. Unfortunately, this often adds considerable time, costs, and unhappiness to the attorney’s client.

What we also see is attorneys who think they have their case solved, encounter unexpected and often very difficult (for the attorney) claims by the opposing counsel. For example, we frequently see in John Doe cases where an IP address has been obtained, and then a name of the person using the IP address was obtained, so now the person is “caught”, right? However, a common defense then becomes “my client’s computer was hacked and thus they did not do it.” Often, this type of defense can totally derail a case where in reality; it might be fairly straight forward to handle with CIS as part of your team.

We also frequently help support defense cases that at first blush appear hopeless. In these cases, we see plaintiffs’ attorneys make unsubstantiated claims. Since the defense attorney is often outside their technical abilities, the attorney will turn to their IT expert. The vast majority of the time, while very technical in nature, these experts are poorly equipped to develop plans to counter and disprove many such claims. CIS experts however can easily handle these situations.
